These Terms of Service govern your use of the Scrivi web application and all related services. By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. Description of Service

Scrivi provides video transcription and AI-powered summarization for videos from YouTube, Instagram, TikTok, X, and Facebook. The Service extracts available captions and generates AI summaries, key points, chapters, and more. The availability and accuracy of transcriptions depend on the availability of captions on the source platform.

3. Contract Formation

A contract between you and the operator is formed when you successfully register an account. For paid subscriptions, the contract for the paid service is formed upon successful completion of the payment process via Stripe. You will receive a confirmation of your subscription via email.

4. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You may delete your account at any time from the Settings page.

5. Subscriptions and Billing

Free accounts are limited to 3 transcriptions per day with 3 AI summaries. Collections, exports, batch transcription, and research reports require a Pro subscription. Pro subscriptions are billed monthly ($9.99/month) or yearly ($59.99/year) through Stripe. All prices are final prices. You can cancel your subscription at any time; access continues until the end of the current billing period.

6. Right of Withdrawal (Widerrufsrecht)

If you are a consumer within the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., an email to support@scrivi.app). To meet the withdrawal deadline, it is sufficient to send the notice before the 14-day period has expired.

If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. Reimbursement will be made using the same means of payment you used for the initial transaction.

Please note: If you have expressly consented to the immediate provision of the digital service and acknowledged the loss of your right of withdrawal upon full contract performance, the right of withdrawal may expire prematurely.

7. Intended Use and Acceptable Use

The Service is intended to be accessed exclusively through the official channels provided by the operator: the Scrivi web application, official browser extensions, and any official mobile applications released in the future. Any access to the Service through unofficial means—including but not limited to automated scripts, bots, scrapers, unofficial API clients, or other programmatic access methods not explicitly provided or authorized by the operator—is prohibited.

You may only transcribe videos you have the right to access. You must not use the Service to violate copyright, distribute harmful content, or circumvent or abuse usage limits, rate limits, or any other technical restrictions. Attempting to exceed, bypass, or manipulate the usage limits applicable to your plan constitutes a violation of these terms.

We reserve the right to suspend or terminate accounts, without prior notice, that violate these terms or use the Service in ways that are abusive, excessive, or otherwise detrimental to the operation of the Service or other users.

8. Intellectual Property

Transcripts and AI summaries generated from your videos belong to you. The Scrivi brand, design, and software remain the intellectual property of the operator. Video content remains the property of its original creators.

9. Limitation of Liability

We are liable without limitation for damages arising from injury to life, body, or health caused by intentional or negligent breach of duty by us, our legal representatives, or our agents, as well as for damages caused by intentional conduct or gross negligence.

For damages caused by simple negligence, we are only liable in the event of a breach of a material contractual obligation (an obligation whose fulfilment is essential to the proper execution of the contract and on whose compliance the contractual partner regularly relies). In such cases, liability is limited to the foreseeable, typically occurring damage.

Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected. We do not guarantee the accuracy of transcripts or AI-generated summaries.

Information about the processing of your personal data can be found in our Privacy Policy.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, you additionally enjoy the protection of the mandatory provisions of your country of residence.

12. EU Online Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

We are not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration body.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify registered users via email. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.

14. Severability

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
